JuanWorks PH is a digital marketplace platform only and does not provide construction, engineering, architectural, or any professional services. All Service Providers are independent third parties.

JuanWorks PH does not control, supervise, or guarantee any service performed. Any agreement entered into is strictly between users.

1. Introduction

Welcome to JuanWorks PH (“Platform,” “We,” “Us,” “Our”).

By accessing or using the Platform, you (“User,” “Client,” “Service Provider”) agree to be legally bound by these Terms.

If you do not agree, you must not use the Platform.

Electronic acceptance (e.g., clicking “Sign Up”) constitutes a legally binding agreement.

2. Nature of the Platform

2.1 Marketplace Only

JuanWorks PH provides a technology platform that connects Clients and independent Service Providers.

We are not a party to any agreement formed between users.

2.2 No Employment or Agency

Nothing in this Platform creates:

• Employment
• Agency
• Partnership
• Joint venture

2.3 Independent Engagement

All transactions, agreements, and outcomes are solely the responsibility of the users involved.

2.4 No Guarantee of Providers or Services

JuanWorks PH is a marketplace and matching platform only and does not guarantee the quality, legality, safety, suitability, availability, licensing status, qualifications, permits, certifications, pricing, or performance of any Service Provider. Any decision to engage a Service Provider is made solely at the user’s discretion and risk.

3. Assumption of Risk

Users acknowledge that engaging with third-party providers involves risks, including but not limited to:

• Financial loss
• Property damage
• Personal injury
• Project delays or failure
• workmanship (poor quality work)

All such risks are fully assumed by the user.

4. User Responsibilities

Users agree to:

• Provide accurate and truthful information
• Comply with all applicable Philippine laws
• Act in good faith in all transactions
• Independently verify credentials before engagement

Users are solely responsible for their conduct and decisions.All agreements, payments, and performance obligations are strictly between Clients and Service Providers unless otherwise specified.

5. Verification & User Content

5.1 Verification & Identity Checks

JuanWorks PH may request and review certain documents, information, or credentials for onboarding, compliance, trust, safety, fraud prevention, or account administration purposes.

Unless expressly stated otherwise, any verification conducted by JuanWorks PH is limited in scope and does not constitute a certification, endorsement, guarantee, warranty, or representation regarding a user’s competence, qualifications, licensing status, experience, legality, reliability, safety, or quality of work.

Unless expressly stated otherwise, JuanWorks PH verifies identity information only and does not independently verify all licenses, permits, certifications, qualifications, professional credentials, training records, work experience, or professional competence of users.

Approval, registration, subscription status, profile visibility, badges, reviews, ratings, or continued access to the Platform shall not be be interpreted as an endorsement or guarantee by JuanWorks PH.

5.1A Provider Representations & Warranties

Each Service Provider represents, warrants, and agrees that:

• All information, documents, credentials, qualifications, certifications, licenses, permits, registrations, work history, and other content submitted to JuanWorks PH are true, accurate, current, complete, and not misleading;
• They possess and will maintain any licenses, permits, registrations, certifications, qualifications, or legal authorizations required by applicable law to perform the services offered;
• They have the legal right, authority, and capacity to offer and perform the services listed on the Platform;
• They will comply with all applicable laws, regulations, industry standards, and governmental requirements relating to their services.

Service Providers acknowledge that they are solely responsible for the accuracy, legality, and completeness of all information submitted through the Platform.

5.2 No Guarantee of Competency

Profiles, reviews, ratings, and credentials are user-generated.

We do not guarantee:

• Skills
• Experience
• Pricing accuracy
• Work quality

5.3 Reviews & Ratings

The Platform may allow users to submit reviews, ratings, comments, and feedback regarding their experiences with other users.

Reviews and ratings reflect the opinions of individual users and do not constitute endorsements, guarantees, or representations by JuanWorks PH.

Users shall not post false, misleading, fraudulent, defamatory, retaliatory, or manipulated reviews.

JuanWorks PH reserves the right, but not the obligation, to investigate, moderate, edit, remove, or refuse publication of reviews that violate these Terms or appear unreliable, abusive, fraudulent, or unlawful.

6. Platform Tools

The Platform may provide:

• Matching systems
• Messaging
• Quotation tools
• Scheduling
• Notifications

These tools are facilitative only and do not create responsibility for user behavior.

7. Payments & Financial Transactions

7.1 Third-Party Processing

Payments are handled by external providers.

JuanWorks PH:

• Does not store financial data
• Is not a financial institution

7.2 No Payment Liability

We are not responsible for:

• Failed or delayed payments
• Fraudulent transactions
• Chargebacks
• Incorrect payments

7.3 No Escrow Responsibility (if applicable)

Unless explicitly stated, JuanWorks PH does not act as escrow or custodian of funds.

8. Safety & Compliance Disclaimer

JuanWorks PH is not responsible for:

• Job site safety
• Compliance with building codes
• Engineering standards
• Permits or regulatory requirements

All such obligations rest solely with the users.

9. Limitation of Liability

To the fullest extent permitted by law, JuanWorks PH shall not be liable for:

• Property damage, injury, or death
• Fraud, scams, or criminal acts
• Poor workmanship or delays
• Disputes between users
• Loss of data or platform downtime
• Indirect or consequential damages

10. Indemnification (CRITICAL CLAUSE)

Users agree to indemnify, defend, and hold harmless JuanWorks PH and its affiliates from any claims, damages, liabilities, losses, or expenses arising from:

• Use of the Platform
• Violation of these Terms
• Disputes with other users
• Breach of laws or regulations

11. Dispute Resolution Between Users

JuanWorks PH is not obligated to mediate or resolve disputes.

Users agree to:

• Resolve issues directly
• Pursue legal remedies independently

We may (but are not required to) provide:

• Chat logs
• Transaction records

11A. Complaints, Reports & Takedown

JuanWorks PH may provide mechanisms for users to report suspected fraud, misrepresentation, fake credentials, unlawful activity, unsafe conduct, or violations of these Terms.

Upon receiving a report, JuanWorks PH may, at its sole discretion:

• Request additional documentation;
• Conduct reasonable investigations;
• Suspend or restrict account access;
• Remove profiles, content, reviews, or listings;
• Permanently terminate accounts.

JuanWorks PH is not obligated to investigate every report but reserves the right to take action when deemed appropriate.

12. Prohibited Activities

Users must not:

• Commit fraud or misrepresentation
• Harass or abuse others
• Upload malicious software
• Use the platform for illegal purposes
• Circumvent the platform to avoid fees

Violations may result in:

• Suspension
• Permanent banning
• Legal reporting

13. Off-Platform Transactions

Users who intentionally bypass the platform to avoid fees may face:

• Account suspension
• Permanent banning
• Loss of access to platform services

14. Platform Rights & Enforcement

JuanWorks PH reserves the right to:

• Monitor activity (as permitted by law)
• Investigate suspicious behavior
• Suspend or terminate accounts
• Report illegal activities to authorities

15. Data Privacy

JuanWorks PH processes personal data in accordance with its Privacy Policy and the Data Privacy Act of 2012.

By using the Platform, users consent to the collection, processing, storage, and use of their information as described in the Privacy Policy.

Users acknowledge that while JuanWorks PH implements reasonable security measures, no online platform or transmission method can be guaranteed to be completely secure.

16. Changes to Fees, Subscription Plans & Platform Pricing

JuanWorks PH reserves the right to modify, increase, decrease, introduce, remove, or restructure any fees, subscription plans, premium features, pricing models, billing methods, commissions, service charges, or payment terms at any time.

Where required by applicable law, reasonable notice of such changes shall be provided to affected users.

Continued use of the Platform after the effective date of any pricing or subscription change shall constitute acceptance of such changes.

JuanWorks PH may also introduce new paid services, premium features, subscription tiers, promotional pricing, or bundled offerings at its discretion.

17. Service Availability

JuanWorks PH may modify, update, suspend, restrict, or discontinue any feature, service, functionality, or portion of the Platform at any time, to the extent permitted by applicable law.

JuanWorks PH shall not be liable for any interruption, modification, suspension, or discontinuation of services.

17A. Electronic Communications

By creating an account or using the Platform, users consent to receive notices, disclosures, updates, account-related communications, legal notices, and other communications electronically through the Platform, email, SMS, or other electronic means.

Electronic communications shall satisfy any legal requirement that such communications be made in writing.

18. Intellectual Property

All platform content (logos, code, design, systems) is owned by JuanWorks PH.

Users are granted a limited, non-transferable license to use the platform.

19. Force Majeure

JuanWorks PH is not liable for failure or delay due to events beyond control, including:

• Natural disasters
• Power outages
• Internet failures
• Government actions

20. Termination

We may suspend or terminate accounts for:

• Violations of Terms
• Fraud or abuse
• Legal complaints
• Non-payment
